Why register my brand?​​ It seems obvious, but a lot of people don’t know!

The Brand probably is one of the most precious assets of a business, as it is the main link with the customer. However, what many people don’t know is that the Brand is a property, like land, for example.​

If you don’t register it, you don’t own it , and worse, someone could end up registering ir before you, preventing you from using it, and maybe even charging you a compensation for using a Trademark Registration without authorization.

By registering it, you receive a registration certificate (valid as a deed of a property) and you have the right to the brand, being able to sell, license products, franchise the Brand (and only Brands that have already entered the registration can franchise).

  • Responsible agency: INPI – National Institute of Intellectual Property.​
  • Registration can be done through an CNPJ (National Legal Entity Register) or by and individual as well.​
  • When you file your Trademark application, you get a number that we call priority. The process takes around 12 months to complete. But priority means that if someone tries to register after you, you’ll have the priority, that is, they will review your registration request first​.
  • The Trademark registration is valid for 10 Years, and may be renewed for equal and successive periods, that is, the Trademark may be yours forever. Just renew every 10 years!​
  • The trademark symbol in Brazil is the ®, which indicates that the brand in question is duly registered with the responsible agency in Brazil, the INPI, and may not be copied or misused by third parties.​

  • Responsible agency is the SIC (Superintendence of Industry and Commerce).​
  • The registration process takes approximately 8 to 12 months.​
  • In some products, trademark registration is mandatory. In other cases where it is not mandatory, the risk is that the trademark holder will be the one who registered it and not the one who uses it, and the registration holder may claim you for selling a product with a trademark that is not yours. ​
  • The trademark registration lasts for 10 years and must be renewed before its expiration or a maximum of 6 months after expiration.​
  • The trademark registration is done by: National Service for Intellectual Rights (SENADI)​.
  • ​The process takes approximately 6 to 8 months.​
  • The validity of the trademark in Ecuador is 10 years.​
  • The Trademark Registration are done at the IMPI – Mexican Institute of Industrial Property.​
  • IMPI administrates patents, trademarks, utility models, industrial designs, integrated circuit layout design and designation of origin.​
  • They are divided in 34 products and 11 services. The brand availability study starts at MARCANET and MARCIA. On these 2 platforms, you are looking for COMMERCIAL NAME and NOTICE.​
  • The search is done by Brand, Slogan, Logo and Class. In the study you can find its availability or similarity with other brands. Depending on the result, the trademark may or may not be made at the IMPI. The study takes 4 to 6 months to obtain the trademark concession by the IMPI.​
  • A declaration of use is filed every 3 years. This declaration is for not losing the trademark e having to re-register it.​
  • The trademark registration is done by: INDECOPI – National Institute for the Defense of Competition and Protection of Intellectual Property.​
  • Process time is 3 to 6 months, depending on whether the trademark application has submitted observations from the regulatory company or opposition from other companies.​
  • Trademark registration lasts for 10 years and can be renewed consecutively, that is, every 10 years and indefinitely.​
  • There are 45 classes: 34 for products and 11 for services.​
